Withdrawal and rendered
Sales via the Internet of the products on the SiteShop.dessyelettrophornature.itThey are identified as distance contracts, therefore governed by Legislative Decree no. 206 of 6 September 2005.
If the user is a consumer, or a natural person who acquires the goods for purposes not referable to his professional activity, he has the right to exercise the right of withdrawal from the purchase contract for any reason, without the need to provide explanations and without any penalty . To exercise this right, the consumer has 14 (fourteen) calendar days from the date of receipt of the order made. The withdrawal period expires after 14 days from the date on which the user or a third party, different from the carrier and designated by the user, acquires the physical possession of the products purchased.
To exercise the right of withdrawal, the user must inform Dessy Srl, before the expiry of the withdrawal period, of his decision to withdraw. To this end, the user must send the request for withdrawal to Dessy Srl:
- by email to e -mail addressshop@dessysrl.it- via registered letter - addressed to Dessy srl - Via Mercalli 5/7/9, Cap 09129 Cagliari (CA).
Once the aforementioned communication of withdrawal has been received, Dessy Srl will immediately communicate to the Customer, by e-mail or by telephone, the receipt of the request for withdrawal and will inform the user regarding the methods of returning the goods.
The user must return the products to Dessy Srl, using a carrier of his choice, without undue delay and in any case within the deadline of 14 calendar days from the date on which he communicated to Dessy Srl his decision to withdraw. The term is respected, if the user respects the product (s) before the expiry of the period of fourteen days. The products, suitably protected and packed, must be sent to the following address: Dessy srl - via Mercalli 5/7/9, cap 09129 Cagliari (CA).
The return of the product (s) to Dessy srl takes place under the responsibility and the user's expense. For this reason, in the event of damage to the goods during transport, Dessy srl will immediately notify the customer of the incident, to allow him to promptly file a complaint against the carrier he chose and obtain the reimbursement of the value of the property (if insured) . For the purposes of the deadline, the products are intended to be returned when they are delivered to the carrier.
If the user decides to make use of the right of withdrawal, Dessy srl will proceed to reimburse the total amount paid by the user for the product/s, including delivery costs, without undue delay and in any case no later than 14 days of calendar from the day on which Dessy Srl has been informed of the user's decision to exercise this right.
The right of withdrawal is however subject to the following conditions:
- the right applies to the products purchased in their entirety
- The goods purchased must be intact and returned to the original packaging, complete in all their parts (including any documentation and accessory equipment, for example: manuals, cables, etc.).
- It is not possible to exercise withdrawal only on part of the product purchased (for example: accessories, cables, etc.).
- The law does not apply to sealed products once open (for example: sealed switches, etc.).
The user is responsible for the decrease in the value of the assets resulting from a manipulation of the product (I different from that necessary to establish their nature, characteristics and functioning. In the event that the products for which the withdrawal has been exercised have suffered a decrease in value resulting from a manipulation of the goods other than that necessary to establish nature, characteristics and operation, the amount of the refund will be reduced by a amount equal to this decrease in value. Dessy srl srl will promptly communicate to the user, by e-mail, of the circumstance and the consequent decrease in the refund amount; providing the same, in the event that the reimbursement has already been paid, the bank details for the payment of the amount due by the user due to the decrease in value of the product (s).
In the event that the withdrawal has not been exercised in accordance with the provisions of the applicable legislation (legislative decree of 21 February 201, n. 21), it will not entail the termination of the contract and, consequently, will not entitle any refund. Dessy Srl will notify the user by e-mail, rejecting the request for withdrawal. The product (s) will remain/will remain at Dessy Srl available to the user for the re-sector, which must take place at the expense and under the responsibility of the user himself.
The right of withdrawal decays totally, due to the lack of the essential condition of integrity of the asset/s (packaging and/or content), in cases where Dessy srl ascertains:
- the lack of the original external/internal packaging
- the absence of integral elements of the product (accessories, cables, manuals, parts, etc.)
- damage to the product for reasons other than its transport or for overcoming the time limits required by law for reasons not deriving from Dessy srl.
